Connie, That is correct. DRS can still ‘claw back’ pension payments in the month of death. RPEC supported two bills during the 2025 session that would have ended this provision – HB 1312 and it’s companion bill SB 5114. Both bills stalled in committee during session. There is a chance they can be brought forward again in the 2026 session.
