Providing cost-of-living adjustments for plan 1 retirees of the teachers’ retirement system and public employees’ retirement system. Provides the same annual cost-of-living adjustment for plan 1 retirees of the teachers’ retirement system and the public employees’ retirement system as is provided for plan 2 and plan 3 members of those systems.
HB 2298 Domestic partnerships/PERS H Rules R Moeller Support
Addressing survivor benefits from the public employees’ retirement system for survivors of members in registered domestic partnerships prior to December 2012. Requires the department of retirement systems to adopt rules to permit certain spouses of public employees’ retirement system members the opportunity to designate themselves as a postretirement marriage survivor between September 1, 2016, and December 31, 2016, provided the retirement allowance payable to the retiree is not subject to periodic payments pursuant to a property division obligation.

Providing a choice between membership in the public employees’ retirement system plans 2 and 3 for employees age twenty-five or less in subsequent terms of employment. Authorizes an employee to choose to earn future service credit as a member of plan 2 or plan 3 of the public employees’ retirement system if they are: (1) Age twenty-five or less; (2) Validly separated from employment from an employer; and (3) Subsequently employed by a different employer in an eligible position.

Modifies provisions in the public employees’ retirement system, the teachers’ retirement system, and the school employees’ retirement system with regard to plan membership default.

Concerning employment after public service in state government. Prohibits certain former state officials and employees from lobbying or attempting to influence state government within one year of leaving public service. Requires certain former state officials and employees to disclose certain employment activities for one year after leaving public service.
SB 6433 Forfeiting public pensions S Ways & Means Bailey Monitoring
Authorizing the forfeiture of the pension of a public employee convicted of a felony for misconduct associated with such person’s service as a public employee. Requires a court, if a member of a state retirement system or plan is convicted of or pleads guilty or nolo contendere to an offense that is a class 1, 2, 3, 4, or 5 felony that was committed in the course of, or was related to, the member’s employment as a public official or public employee, to order the person’s membership terminated and the person shall forfeit all rights and benefits earned under the state retirement system or plan.
SB 6434 Garnishing public pensions S Ways & Means Bailey Monitoring
Garnishing public pensions to pay for the costs of incarceration of a public employee convicted of a felony for misconduct associated with such person’s service as a public employee. Addresses the department of retirement systems’ compliance with an order to garnish up to fifty percent of the gross monthly benefit for costs of incarceration, probation, parole, or restitution imposed on a member, former member, or retiree as a result of a conviction of or a plea of guilty or nolo contendere to the commission of a felony for misconduct associated with the person’s service as a public employee for which credit in the plan was earned or accrued, for felonies committed on or after July 1, 2015.
